Acceptable Use Policy

1. Overview

This Acceptable Use Policy (“AUP”) governs your use of ClawTrust services, including all AI agents provisioned on your behalf. Your agent's actions are YOUR actions under the law. Violations of this AUP may result in immediate suspension or termination of your account without notice or refund.

This AUP supplements and is incorporated into the ClawTrust Terms of Service located at /terms. By using ClawTrust, you agree to comply with both documents.


2. Agent Accountability

You are the principal; your AI agent acts as your authorized agent. This is a legal relationship with binding consequences:

  • All actions taken by your agent are legally attributable to you as if you performed them yourself
  • You are responsible for configuring, supervising, and monitoring your agent at all times
  • You must review agent actions regularly and implement appropriate oversight controls
  • You must ensure your agent is configured to comply with all applicable laws and regulations
  • “I didn't know my agent did that” is NOT a defense under any circumstances

By subscribing to ClawTrust, you accept full legal responsibility for everything your agent does while operating under your account.


3. Email Compliance (CAN-SPAM Act)

THIS IS THE HIGHEST-RISK SECTION. READ CAREFULLY.

CAN-SPAM WARNING

Your agent sends email on YOUR behalf. Under the CAN-SPAM Act, you are personally liable for every email your agent sends. The FTC can impose penalties of up to $51,744 per violating email.

Your agent sends email on YOUR behalf using an @deskoperations.com address. Under the CAN-SPAM Act (15 U.S.C. 7701-7713), you are personally liable for every email your agent sends. The Federal Trade Commission (FTC) can impose penalties of up to $51,744 per violating email.

3.1 Required Email Compliance

You MUST ensure every commercial email sent by your agent:

  • Contains accurate “From” information clearly identifying your business or individual identity
  • Has a clear and conspicuous subject line that accurately reflects the content and is not deceptive
  • Identifies the message as an advertisement when applicable
  • Includes your valid physical postal address (street address or P.O. box)
  • Contains a clear, conspicuous, and functioning unsubscribe mechanism
  • Honors unsubscribe requests within 10 business days

3.2 Prohibited Email Practices

You MUST NOT use your agent to:

  • Send unsolicited bulk email (spam) to recipients who have not opted in
  • Send emails to purchased, rented, or scraped email lists
  • Use deceptive headers, subject lines, or sender information
  • Harvest or scrape email addresses from websites, directories, or social media
  • Send emails that impersonate another person or entity without explicit authorization
  • Use misleading routing information or falsified sender domains
  • Send emails after a recipient has unsubscribed

3.3 Email Rate Limits

ClawTrust enforces reasonable sending limits on all tiers to prevent abuse and protect email deliverability for all customers. Sending limits vary by subscription tier and may be adjusted at ClawTrust's discretion. Current limits are displayed in your dashboard.

Exceeding applicable limits or exhibiting spam-like sending patterns (high bounce rates, spam complaints, sending to invalid addresses) will result in immediate throttling or suspension of your Agent's email capabilities.


4. Prohibited Content

You must not use ClawTrust to create, store, transmit, distribute, or process:

  • Spam, unsolicited commercial communications, or bulk email
  • Phishing content, spoofing attempts, or social engineering materials
  • Malware, viruses, trojans, worms, or any malicious code
  • Child sexual abuse material (CSAM) or content exploiting minors
  • Content that promotes, incites, or glorifies violence, terrorism, or hate
  • Content that infringes or violates intellectual property rights
  • Personally identifiable information (PII) of others without valid consent
  • Content that violates export control laws or economic sanctions
  • Content that violates any applicable federal, state, local, or international law

5. Prohibited Activities

You must not use ClawTrust services to:

  • Conduct or facilitate fraud, scams, pyramid schemes, or deceptive practices
  • Impersonate individuals, businesses, government entities, or other organizations
  • Create accounts on third-party services without proper authorization
  • Circumvent access controls, rate limits, paywalls, or security measures on any system
  • Perform unauthorized vulnerability scanning, penetration testing, or security research
  • Launch denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, or network flooding
  • Mine cryptocurrency or perform proof-of-work calculations
  • Resell, sublicense, rent, lease, or redistribute ClawTrust infrastructure or services
  • Interfere with, disrupt, or attempt to access other customers' agents or infrastructure
  • Violate the terms of service of third-party platforms (Google, Microsoft, Stripe, etc.)
  • Engage in money laundering, terrorist financing, or sanctions evasion
  • Engage in any activity that is illegal, fraudulent, or harmful in your jurisdiction

6. AI-Specific Restrictions

Due to the autonomous nature of AI agents, additional restrictions apply:

  • Financial transactions: Do not configure agents to make autonomous financial transactions, purchases, or payments exceeding $100 without human approval
  • Legal agreements: Do not configure agents to execute contracts, legal agreements, or binding commitments on your behalf without human review and explicit authorization
  • Synthetic media: Do not use agents to generate deepfakes, voice clones, or synthetic media designed to deceive or defraud
  • Automated decisions: Do not use agents to make automated decisions that materially affect individuals (employment, credit, housing, insurance, benefits) without human oversight and compliance with applicable law
  • Disclosure requirements: You must clearly disclose to third parties when they are communicating with an AI agent where required by law or where a reasonable person would expect to interact with a human
  • Supervised delegation: Do not delegate tasks to agents that require professional licensing, certification, or human judgment as required by law (medical diagnosis, legal advice, etc.)

7. Infrastructure Restrictions

ClawTrust provisions dedicated infrastructure for your agent. You must not:

  • Modify VPS configuration, firewall rules, or network settings outside approved methods
  • Install unauthorized software, containers, or services on provisioned infrastructure
  • Attempt to access, probe, or scan other tenants' infrastructure, networks, or data
  • Use infrastructure for purposes unrelated to your ClawTrust subscription
  • Exceed bandwidth, storage, compute, or API rate limits as defined by your subscription tier
  • Disable, circumvent, or tamper with logging, monitoring, or security controls
  • Run processes that materially degrade infrastructure performance for other customers

8. Monitoring and Enforcement

ClawTrust reserves the right to monitor your use of services to ensure compliance with this AUP. This includes:

  • Monitoring agent behavior for compliance with this AUP and applicable law
  • Reviewing email sending patterns, content, and recipient responses for spam indicators
  • Analyzing resource usage to detect abuse, cryptocurrency mining, or malicious activity
  • Investigating reports of abuse from third parties or service providers
  • Suspending or throttling agents exhibiting abusive, illegal, or harmful patterns
  • Immediately terminating accounts for severe violations without notice or refund

8.1 Enforcement Actions

Violations of this AUP will result in enforcement actions proportionate to the severity and intent of the violation:

ClawTrust may take enforcement action without prior notice when necessary to protect the integrity of our systems, other customers, or third parties.

8.2 No Liability for Enforcement

ClawTrust is not liable for any damages, losses, or consequences resulting from enforcement actions taken in good faith to enforce this AUP, including:

  • Loss of data, configurations, or agent state due to suspension or termination
  • Business interruption or lost revenue during suspension or investigation
  • Reputational harm from disclosure to law enforcement or third parties
  • Costs associated with migrating to alternative services

9. Reporting Abuse

If you believe ClawTrust services are being used in violation of this AUP, please report it immediately:

We investigate all abuse reports within 24 hours.

Please include:

  • Description of the violation
  • Email headers or message content (for spam reports)
  • Date, time, and sender information
  • Any evidence or documentation supporting the report

If you receive spam from an @deskoperations.com email address, please report it to abuse@clawtrust.ai with full headers. We take spam reports seriously and will investigate promptly.


10. Third-Party Complaints

If ClawTrust receives abuse complaints, legal notices, or subpoenas related to your account, you agree to:

  • Respond promptly to our requests for information or clarification
  • Cooperate fully with investigations and remediation efforts
  • Indemnify and hold ClawTrust harmless from claims arising from your use of services
  • Reimburse ClawTrust for legal fees and costs incurred responding to complaints about your account

11. Changes to This Policy

ClawTrust may update this Acceptable Use Policy at any time to reflect changes in law, technology, or business practices. We will notify you of material changes by email to your account address. Changes become effective 30 days after notice is sent, unless otherwise specified.

Your continued use of ClawTrust services after the effective date constitutes acceptance of the updated AUP. If you do not agree to the changes, you must discontinue use of the services before the effective date.
